General Terms and Conditions of Sale

The purpose of these general terms and conditions of sale is to define the contractual relationship between DG Minéraux and the customer. They specify the ordering process, payment methods, delivery conditions, and possible product returns.

The customer, defined as a user of the DG Minéraux website, acknowledges having read and accepted these general terms and conditions of sale without reservation.

The customer also acknowledges that acceptance of these terms does not require a handwritten signature. Consequently, any order placed for products implies full and irrevocable acceptance of all these terms and conditions of sale.

The customer declares having the full legal capacity required to accept these general terms and conditions of sale. If the customer is not legally capable of entering into a contract, particularly in the case of an unemancipated minor, prior authorization from their legal representative must be obtained before placing any order.

The customer may access these general terms and conditions of sale freely and at any time via the “Terms and Conditions of Sale” link. The customer may also save or print them under their own responsibility.

Order processing

When the customer wishes to place an order, they will be asked to complete a form according to the instructions provided on the website.

The requested information may include:

  • first and last name;
  • postal address;
  • telephone number;
  • email address.

This information is necessary for customer identification and for processing and delivering the order.

The “double-click” performed when validating the order summary constitutes an electronic signature having the same legal value as a handwritten signature for both parties.

This validation makes the order irrevocable and it cannot be cancelled without the agreement of DG Minéraux.

Any order will be confirmed by email sent to the address provided by the customer. It is the customer’s responsibility to provide a valid email address.

DG Minéraux recommends that the customer keep a copy of the order summary until receipt of the confirmation email.

Order forms and invoices are stored by DG Minéraux on a reliable and durable medium that may be produced as evidence.

Privacy

The information requested during the order process is necessary for processing and delivering products.

DG Minéraux undertakes never to sell or disclose this information in order to preserve the privacy of its customers.

The customer may modify their personal information from their customer account.

In accordance with French Law No. 78-17 of January 6, 1978 relating to information technology, files, and civil liberties, the customer has the right to access, modify, rectify, and delete personal data concerning them.

To exercise this right, the customer may contact the website administrator through the contact page.

Session cookies are necessary for the operation of the customer account area and are stored on the user’s computer.

Third-party cookies may also be used to enable links to social networks. These cookies are not used by the manager or administrator of the website.

Product information

The customer has access to photographs and descriptions allowing them to know the essential characteristics of the minerals offered for sale.

Despite the care taken in their preparation, photographs and descriptions are provided for informational purposes only, particularly regarding specimen colors, which may vary depending on the customer’s computer equipment.

No descriptive document relating to jewelry or minerals may call into question the validity of an order.

The offers presented on the DG Minéraux website are valid while stocks last. In the event of stock shortage or cancellation, no compensation may be granted.

Pricing information

All prices displayed are expressed in euros, all taxes included.

In accordance with Article 293 B of the French General Tax Code, VAT is not applicable.

Prices are provided for informational purposes and may be modified at any time. They are only valid on the date the order is confirmed.

The displayed prices do not include shipping costs. These are indicated before final validation of the order.

By validating the order, the customer also accepts the associated shipping costs. These may not constitute grounds for cancellation of the order.

Any customs fees remain the responsibility of the customer.

Full payment for the order, including products and any shipping costs, must be completed before shipment.

No product will be shipped until the full amount due has been paid.

Payment methods

The customer may pay for their order by secure credit card payment via Stripe or via PayPal.

The customer guarantees that they are fully authorized to use the selected payment method.

In the event of refusal of payment authorization by accredited organizations or in the event of non-payment, DG Minéraux reserves the right to suspend any order processing and delivery.

DG Minéraux also reserves the right to refuse an order or delivery in the following cases:

  • order not fully paid;
  • ongoing payment dispute.

In the event of fraud or non-payment, DG Minéraux reserves the right to initiate legal proceedings.

Secure payment

In order to guarantee optimal payment security, credit card numbers do not pass through and are not stored on DG Minéraux servers.

Stripe and PayPal handle the different stages of the transaction through a secure protocol allowing encryption of exchanged information.

Delivery conditions

Shipping rates

Shipping costs depend on the delivery address provided by the customer during the order process.

  • Mainland France: €7.90 – Free from €100 of purchase.
  • Europe: €9.90 – Free from €150 of purchase.
  • Rest of the world: €18.90 – Free from €200 of purchase.

Shipping and delivery times

The shipping time is a maximum of 3 business days from payment validation and/or confirmation.

The delivery times provided by La Poste are indicative only:

  • Mainland France: 48 hours
  • Europe: 3 to 5 business days
  • Rest of the world: 4 to 8 business days

The customer will be informed by email once the order has been shipped.

In cases of force majeure or exceptional events (natural disaster, epidemic, strike, war, etc.) preventing or delaying delivery, DG Minéraux cannot be held responsible.

Claims regarding delivery errors

Any claim regarding a delivery error or product non-conformity must be made on the day of delivery or at the latest on the first business day following receipt.

Any claim made after this period will be rejected.

Any claim that does not comply with the procedures and deadlines indicated above cannot be taken into account and releases DG Minéraux from all liability.

Shipping and return costs remain the responsibility of the customer.

Customs

It is the customer’s responsibility to check the customs regulations applicable in their country.

All costs related to international importation (customs duties, VAT, taxes, or other fees) remain exclusively the responsibility of the customer.

DG Minéraux cannot be held responsible for damage caused during customs inspections.

Returns and warranty

Right of withdrawal

In accordance with current legislation, the customer has a period of 14 business days from delivery to return, at their own expense, any product that does not meet their expectations.

If this period expires on a Saturday, Sunday, public holiday, or non-working day, it is extended until the next business day.

Returns

Any return must first be reported to DG Minéraux: dgmineraux@gmail.com

Returns must be shipped in a resistant parcel and must include a tracking number.

DG Minéraux cannot be held responsible for breakage, loss, or theft of returned parcels.

As part of the right of withdrawal, the customer may choose between:

  • a credit valid for 2 months;
  • a refund processed within a maximum of 7 days.

Return shipping costs remain the responsibility of the customer.

Only items returned complete, in their original packaging, and in perfect resale condition may be accepted.

Any damaged product or product with deteriorated packaging cannot be refunded or exchanged.

DG Minéraux reserves the right to request proof of identity and payment documents (identity card and bank statement proving the purchase).

Warranty

The customer benefits from:

  • the legal warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code);
  • the legal conformity warranty (Articles L. 211-1 to L. 212-14 of the French Consumer Code).

The warranty against hidden defects applies within the framework of normal use of the product.

The following are excluded from the warranty:

  • accidental damage;
  • breakage;
  • loss;
  • normal wear and tear;
  • natural aging of products.
